Frequently asked questions

Do crypto brokers need an AFSL in Australia?

Generally yes. If you deal in, arrange or advise on crypto-assets that are financial products, such as crypto derivatives, interests in a managed investment scheme or certain tokens, you need an AFSL with the relevant authorisations. We assess your model and confirm exactly what you require.

An exchange operates a marketplace and may need market-operator-style licensing; a broker is an intermediary that deals in, arranges or advises on crypto-asset financial products on behalf of clients. The two are regulated differently. We license brokers under the AFSL regime for dealing and advice.

Usually authorisations to deal in and provide financial product advice (and often to arrange) across the relevant product classes (derivatives, foreign exchange contracts, MIS interests). We scope the precise authorisations so you are neither under- nor over-licensed.

Where you handle client orders and deal with retail clients, best-execution obligations and design-and-distribution (TMD) requirements generally apply. We build the policies and Target Market Determinations that evidence compliance.

Client money must be held under the Corporations Act client money rules, and crypto-asset custody, whether self-managed or via a third-party custodian, must be clearly documented. We set out how funds and assets are held so responsibilities and protections are clear.

Yes. Crypto broking commonly engages AML/CTF obligations and may require AUSTRAC digital currency exchange (DCE) registration. We develop an AML/CTF program and onboarding and monitoring frameworks tailored to your risk profile.
