Frequently asked questions

Do brokers and brokerage firms businesses need an AFSL in Australia?

It depends on what you do. Dealing in financial products, making a market, arranging, and providing financial product advice, across securities, derivatives, FX and managed investment interests, generally require AFSL authorisations. We assess your business against Australian financial services and markets laws to confirm exactly what you need.

Most brokers need a mix of authorisations (to deal, make a market, arrange and/or advise) specified by product class (securities, derivatives, foreign exchange contracts, MIS interests). We scope the precise authorisations to your model so you are neither under- nor over-licensed.

Beyond holding the licence, brokers must meet obligations including best execution, client money handling, market integrity rules, design and distribution (DDO/TMD), conflicts management and breach reporting. We build frameworks that make these obligations workable day to day.

Not always. You can deal in securities by trading through an existing market participant, or you can apply for participant status with ASX, Cboe or other markets. We advise which route fits your model and handle the participant application where you need it.
